General terms and conditions

Welcome to Blickers, the online store of THE BLICKERS, SL (the “Website”). We bring a multi-generation optical legacy into the digital world to offer a reliable, intelligent and high-quality shopping experience for sunglasses, frames and related products. These Terms and Conditions form the basis of our relationship with you and reflect our commitment to transparency, professionalism and mutual trust.

1. General Information

2. Validity of General Conditions

2.1. Please read these Terms carefully and make sure you understand them before ordering any item on the Website. By placing an order you confirm that you agree to these Terms and Conditions and you declare that:
• You understand the conditions set out herein.
• You are at least eighteen years old or otherwise have sufficient legal capacity to contract. 

2.2. All our offers, products and services are governed exclusively by these Terms and Conditions, including when access occurs from outside Spain. Any customer terms that contradict or differ from these Terms are invalid.

2.3. Blickers may amend these Terms at any time. Any changes will be published on the Website with an update date, and, where appropriate, you will be notified electronically prior to publication.

3. Authenticity

3.1. All products are guaranteed to be 100% genuine and are covered by the manufacturer’s warranty.

3.2. As an authorised retailer, we source only through official channels, maintaining brand warranties and quality standards.

4. Prices

4.1. Prices are those displayed on the Website at any given time.

4.2. Where applicable, prices include taxes.

4.3. Your country’s customs authority may require you to pay taxes or duties upon import.

4.4. Prices do not include shipping or return costs. Where applicable, shipping costs are shown during checkout.

4.5. We accept payments in EUR, GBP, USD or CHF. For other currencies, the charge will be in EUR and your bank/card provider applies the exchange rate.

5. Payments

5.1.  We accept several payment methods. You can find the full list on our Payments & Security page.

5.2. We do not process your order until full payment is received. Bank transfers may take additional days to confirm and stock may no longer be available at the time of confirmation. Please consider this when choosing your preferred method.

5.3. All cardholders are subject to validation checks and authorisation by the card issuer.

5.4. We may request a change of payment method if the selected method cannot be applied.

6. Placing an order

6.1. Our shopping pages guide you through the steps to place an order. You need to register an account to order.

6.2. The order process allows you to review and correct any errors before submitting your order. Take your time to check details at each step and always before payment.

6.3. After placing your order, you will receive an email acknowledging receipt. Please check your junk folder if it does not arrive within a few minutes.

6.4. Items are subject to availability. Because of the time between ordering and processing, stock status may change. If an item is unavailable when processing, we will notify you promptly so you can choose to wait a few days or cancel for a full refund. 

6.5. By placing an order you authorise us to issue the invoice electronically. You can request a paper invoice via the contact section, indicating your details and order number.

7. Order Changes and Cancellations

7.1. The delivery address and your contact details can be amended provided the order has not entered the shipping logistics process. 

7.2. Prescription values/parameters correction and cancellation due to error (2-hour window)
You may correct prescription values and other parameters entered by mistake, and you may also request order cancellation, within 2 hours from order confirmation via My Account (available at all times). If a technical issue prevents access to My Account, you may use the contact section; the date and time of your message will be used to validate notification within the 2-hour window.

7.3 Cancellations
a) Free window: you can cancel at no cost within 2 hours after order confirmation, for any order type, via My Account (or the contact section in case of a technical incident).
b) After 2 hours and before dispatch — non-personalised products (all standard products): a fixed administrative handling cost of €6 applies.
d) Personalised products or goods made to your specifications (for example, glasses with prescription lenses or assemblies with filters, tints or polarisations): no cancellation is accepted once the initial 2-hour period has elapsed. Pursuant to Article 16(c) of Directive 2011/83/EU (as implemented) and Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK), the right to cancel does not apply to goods made to the consumer’s specifications or clearly personalised.
e) Certain products, colours or sizes that are not part of our usual stock may be handled as special orders at the customer’s request. In these cases, once the purchase is confirmed and the order placed with the supplier, it will not be possible to cancel or modify without incurring associated costs.

7.4. Cancellation of Customized Product Orders
7.4.1. Purpose and Scope of Application
This clause governs the cancellation conditions applicable exclusively to customized products, understood as those goods made according to the consumer’s specifications, primarily prescription glasses with ophthalmic lenses manufactured to measure in accordance with the optical prescription provided by the client.
7.4.2. Grounds for Cancellation
The client may request the cancellation of an order for a customized product within two (2) hours from its confirmation and always before the dispatch of the confirmation email of shipment.
7.4.3. Economic Conditions of Cancellation
Acceptance of the cancellation request under the previous section shall entail the following economic conditions:
a) The refund of the amount corresponding to the frame of the product will be processed, from which a fixed fee of €6.00 (six euros) will be deducted as administrative costs, which are non-refundable.
b) The amount paid for the customized ophthalmic lenses shall under no circumstances be subject to refund. This exclusion is based on the nature of goods made according to the consumer’s specifications, whose manufacturing process begins once the order is confirmed, making subsequent reuse or resale to third parties impossible.
7.4.4. Effects of Cancellation
Execution of the cancellation under the terms of this clause shall imply the definitive annulment of the production and shipment of the order. The components of the product, including the non-refundable lenses, shall be withdrawn from the production circuit and discarded, without the client being able to claim their delivery.

8. Right of Withdrawal, Returns and Refunds

8.1. Period: you have the right to withdraw within 14 calendar days from the day you receive the product, without giving any reason. This does not apply to personalised or made-to-specification products (see 8.11).

8.2. Procedure: request the return from My Account and you will automatically receive the instructions and the return address. The product must arrive at the indicated address within 15 days of your request.

8.3. Return costs and return country: Blickers does not charge for processing the return. However, the return shipment is at the customer’s expense and must arrive properly packaged and identified. The return country is Spain; for orders from Germany and the United Kingdom, returns are handled locally in those countries.

8.4. Returns from outside the EU: we recommend attaching the commercial invoice, marking the shipment as “Return of goods”, and arranging the return with duties/taxes paid (DDP) to avoid holds or charges on arrival.

8.5. Product condition for refund (non-personalised products)
• The product must be unused beyond what is necessary to establish its nature, characteristics and functioning (as you would test in a shop).
• Lens films/protective elements and presentation components should be kept in the best possible condition.

8.6 Official accessories and original packaging
The product must include all official accessories and original packaging (case, cleaning cloth and branded boxes). Missing case, cloth or branded boxes will result in an €18 deduction for replacement and handling, in addition to any other reduction for diminished value due to use or deterioration.

8.7. Smartglasses and other technology products
Returns are accepted within the legal withdrawal period set out in these Terms. Devices must be factory-reset, with no linked accounts or services (for example, pairing or location services), and include all official accessories and branded packaging. If the product shows use beyond testing or if official accessories are missing, an appropriate deduction for diminished value may be applied.

8.8. Refund
Refunds will be made within a maximum of 14 days from your withdrawal notice, and may be withheld until we receive the item or credible proof of return. Refunds are processed to the same payment method used for purchase.

8.9. Sealed or shrink-wrapped products
Sealed or shrink-wrapped products lose the right of return if the seal has been opened.

8.10. Refused deliveries or undeliverable parcels
These are treated as withdrawal. The product price is refunded and the cost of the return and other non-recoverable handling costs associated with the shipment are deducted, up to €30 within the EU and €58.99 outside the EU. If standard delivery charges were paid on the original order, those are refunded; any premium/expedited surcharge is not refunded.

8.11 Personalised products or goods made to your specifications
Pursuant to Article 16(c) of Directive 2011/83/EU (as implemented) and Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK), the right to cancel does not apply to goods made to the consumer’s specifications or clearly personalised.

8.12 Communication and internal timelines
Once the returned item is received, we will notify you. The refund process may take up to 14 days from warehouse verification. No refund is due where the product is essentially incomplete, counterfeit, or the parcel arrives empty. Where you contracted the return carriage yourself, any claim must be pursued with the carrier.

9. Commencement and expiry of the contract

9.1. By placing an order you are legally bound by these Terms and Conditions and you make an offer to purchase the goods.

9.2. The contract takes effect when your order is confirmed.

10. Shipping and Delivery

10.1. Subject to availability, goods are dispatched as soon as possible, in line with the delivery estimates shown at checkout.

10.2. If an item is in production, it will be shipped as soon as the supplier delivers it.

10.3. If we foresee an indeterminate delay, we will inform you and refund any amounts paid where applicable.

10.4. Deliveries are made Monday to Friday, excluding destination public holidays.

10.5. While we endeavour to meet estimated timelines, delays can occur due to unforeseen factors (material shortages, carrier incidents, import delays, technical/IT failures or demand peaks). In such cases, Blickers cannot assume liability or compensation for delays attributable to the manufacturer or the carrier, and we will keep you informed of any relevant incident.

10.6. We may make partial deliveries, at no extra cost to you, where reasonable.

10.7 Available shipping options depend on destination and are shown during checkout.

10.8. Shipping charges are added to the item prices.

10.9. The shipping cost depends on the option selected.

10.10. In addition to item prices and shipping charges, taxes and duties may be payable in your country of residence. If these are refused and the order is returned to us, we may reclaim any customs costs incurred and non-recoverable handling costs. 

10.11. You must provide complete and accurate delivery information (including the recipient’s name). We are not responsible for delivery to an incorrect address/person due to incomplete or inaccurate information provided by you.

10.12. If a parcel cannot be shipped due to missing/incorrect contact or delivery information and we cannot obtain a response, it will be treated as withdrawal and clause 8.10 will apply.

10.13 Tracking incidents: if tracking shows “delivered” but you have not received the parcel, open a case via the contact section; we will open an investigation with the carrier (response may take up to 15 days).

10.14 International shipping: Blickers operates from Spain. Outside the EU, import duties and taxes may apply. For the United Kingdom, shipments are sent DDP (duties and taxes paid for the customer).

10.15. Disclaimer of liability for delays
Blickers shall not be held liable for delivery delays caused by circumstances beyond its direct control. These include, but are not limited to, transport service incidents or strikes, customs procedures, force majeure events, or any other circumstance not attributable to Blickers. Such delays shall not, in general, give rise to any right to compensation, refund, or order cancellation.

10.16. Right of termination for excessive delay
Notwithstanding the provisions of section 10.15, if delivery of the order does not take place within seven (7) business days after the latest estimated delivery date indicated during the purchase process, the customer shall be entitled to request termination of the contract. In such case, Blickers will refund the full amount paid by the customer within a maximum period of fourteen (14) calendar days, always using the same payment method employed for the purchase.

11. Invoicing

11.1. Invoices are issued once the order is paid and confirmed.

11.2. The invoice will be emailed when the order ships.

11.3. You can also download it from your customer account page.

11.4. Invoice information cannot be changed after ordering; please ensure your details are correct before purchase.

12. Legal Guarantee

12.1. The legal guarantee period applies according to the consumer’s country of residence: 3 years in Spain; elsewhere in the EU, a minimum of 2 years (or any longer period set by applicable national law). Keep proof of purchase (Blickers order number, order confirmation email, invoice or the email address used to order).

12.2. If, after assessment, a manufacturing defect is confirmed, the product will be replaced at no cost to the customer.

12.3. All claims must be made in writing and any defect must be reported without undue delay once evident. Please send photos or videos clearly showing the defect via the contact section for assessment by our optical team.

12.4. Transport costs:

12.5. If no manufacturing defect is found, you may request the return of the item by paying the corresponding shipping costs (for example, €15 within European countries; €52.99 outside Europe).
• Within the EU: where there are reasonable indications of a manufacturing defect, we will arrange free collection and, after laboratory verification, if the defect is confirmed, we will proceed with free replacement.
• Outside the EU: you send the product at your expense, with duties/taxes paid (DDP) and clearly indicated as a goods return. If a manufacturing defect is confirmed, we will replace the product and ship the replacement at no cost. The outbound carriage is not refunded.

12.6. Exclusions: normal wear and tear (scratches), damage caused by accident/negligence, chemical exposure, misalignment due to use, improper storage or maintenance, or unauthorised modifications/repairs are not covered.

13. Prescription Lenses

13.1.By ordering, you confirm that the prescription information you provide is correct, true and exactly matches the prescription provided by your optician or ophthalmologist.

13.2. Your prescription must be valid on the order date (generally less than one year old unless advised otherwise by a professional).

13.3. When choosing lenses, you may customise prescription, lens quality, coatings, thinning and tints.

13.4. Spectacle and contact lens prescriptions may differ; ensure you order the correct parameters for the intended product.

13.5. We work with leading lens brands; our optical team selects the specific brand based on your prescription and chosen options.

13.6. For glasses we may require your pupillary distance (PD). If not provided, please request it from your optician.

13.7. Production times vary with complexity and lens type; some lenses are made to order and may take extra days.

13.8. Allow a few days to adapt to new lenses. If adaptation issues persist, consult your optician.

13.9. If you believe the prescription supplied is incorrect, open a case via the contact section and we will review it. If an error on our part is confirmed, we will provide an immediate solution.

13.10. Glasses with prescription lenses or customised glazing are personalised or made-to-specification products and are not eligible for withdrawal, without prejudice to defects attributable to Blickers.

13.11. United States customers: where legally required, we may verify your prescription with your optician.

14. No Professional Advice

14.1 Information provided on the Website or by our staff/agents (phone, email, letter, fax or other means) is for informational purposes or general guidance and does not constitute medical or other professional advice.

14.2. Health information provided does not replace medical advice; do not make medical decisions without consulting your healthcare professional.

14.3. Sending questions or suggestions does not create a professional relationship other than as set out in our Privacy Policy.

15. Impact-Resistant Lens Requirements

15.1. All spectacle and sunglass lenses sold by Blickers comply with the applicable impact-resistance regulations for the destination market (for example, 21 CFR 801.410 in the United States). Manufacturers carry out the relevant safety tests.

16. Specific Information on Purchasing Contact Lenses

16.1 The contact lens specification you submit must be valid, correspond to your latest test by a qualified professional and generally be less than one year old.

16.2 We recommend regular eye examinations and checking fit with a specialist if you change brand.

16.3 The manufacturer is solely responsible for product compatibility. Goods are supplied in the manufacturer’s original, unopened packaging. We are not responsible for incorrect use or handling. Do not exceed the recommended wear time. If irritation occurs, stop use immediately and consult an eye-care professional.

16.4 Returns: contact lenses and hygiene products are not accepted if the seal is opened (see 8.9).

17. Intellectual Property

17.1. All content relating to Blickers’ brands, domains, logos, designs or documentation, including software or any other element protectable under intellectual/industrial property laws, accessible by users, is owned by Blickers or its legitimate holders; all usage rights are reserved.

17.2. You may only use such material as expressly authorised by us or our licensors.

17.3. Improper use of the Service or breach of obligations may, at Blickers’ discretion, lead to account cancellation or service suspension, with the legal consequences inherent to such cancellation. 

17.4. You undertake not to remove, delete, alter, tamper with or otherwise modify:
• Notices, legends, indications or symbols of intellectual/industrial property (copyright, ©, ®, ™, etc.).
• Technical protection or identification devices (watermarks, fingerprints, etc.).

17.5. These Terms do not assign or transfer any intellectual/industrial property rights. Access and use are authorised only as set out herein.

17.6. You are not authorised to copy, distribute, transmit, communicate, modify, transform, assign or engage in any activity that entails commercial use of intellectual/industrial property rights, in whole or in part, without the written consent of the right holder.

17.7. Access to and use of the Website shall always be strictly personal and non-commercial.

17.8. Blickers reserves all industrial and/or intellectual property rights it holds.

17.9. No licence or authorisation is granted other than as expressly detailed in this clause. 

17.10. Blickers may terminate or modify licences at any time and for any reason, and may take legal action against any use that:
• Does not comply with these Terms;
• Infringes intellectual/industrial property rights or analogous rights of Blickers or any third party; or
• Breaches any applicable regulation.

18. Access and Use

18.1. Any access to and use of the information and content on this Website is your sole responsibility.

18.2. Access conditions are subject to law and to principles of good faith and lawful use; any action intended to damage Blickers is prohibited.

18.3. Use of this Website for unlawful or unauthorised purposes is prohibited.

18.4. Any form of exploitation is prohibited, including reproduction, distribution, assignment to third parties, public communication and transformation, by any means, without the prior express permission of the respective holders. Breach constitutes an offence punishable by law.

19. User Responsibility

19.1. You are fully responsible for proper access to and use of the Website, subject to national or international law and to principles of good faith, morals, custom and public order.

19.2. You must not use the Website’s services and content for unlawful purposes detrimental to the rights and interests of others, nor damage, disable, impair or deteriorate the Website, its content and services, nor prevent other users from normal use or enjoyment.

19.3. Blickers is not responsible for any use third parties may make of information provided through this Website. Those who breach these obligations will be liable for any loss or damage caused.

19.4. Without prejudice to the above, Blickers reserves the right to refuse, at any time and without prior notice, orders from users who breach these Terms

20. Complaints

20.1 For any complaint and/or incident attributable to Blickers relating to the provision of the Service and/or products purchased, the procedure begins via the contact section available on the Website.

20.2 Blickers undertakes to contact you regarding any complaint within no more than 30 calendar days from notification.

21. Linking Policy

21.1. Individuals or entities wishing to create a hyperlink from another website to any pages of Blickers are subject to the following:
• Total or partial reproduction of services or content of the Website is not authorised without Blickers’ express permission.
• Deep-links, IMG/image links or frames with Blickers pages are not authorised without express permission.

21.2. The existence of any link does not imply any relationship between Blickers and the owner of the originating website, nor Blickers’ knowledge or acceptance of services and content offered there. If you observe links that may be contrary to law, morals or public order, please report them via the contact section.

21.3. Blickers is not responsible for the contents or services available to the public on the website from which the hyperlink is made, nor for the information or statements included there.

22. Governing Law

22.1. In the event of any conflict or discrepancy in the interpretation and/or application of these Terms and Conditions, the competent courts shall be those provided for by the applicable regulations on consumer jurisdiction.

22.2 You may seek to resolve disputes arising during the contractual relationship through the European Commission’s Online Dispute Resolution platform.
